Morocco's Ministry of Equipment and Water Reveals Public Domain Asset Management Progress

The Moroccan Ministry of Equipment and Water has announced substantial advancements in the definition and management of public maritime and port domains. The ministry reported an 82% definition rate for the public maritime domain along the kingdom's coasts, compared to 76% for the public port domain. These figures are part of ongoing efforts to regulate and define public assets through the issuance of definition decrees and the completion of public maritime domain redefinition operations, alongside the continued preservation of the public domain constituting roads.
According to the draft budget for the public sector, expected to be presented by Minister Nizar Baraka to the Committee on Basic Infrastructure of the House of Representatives, the public domain preservation rate across 29 regions stands at 50.50%. The Fez-Meknes region achieved the highest rate at 70.83%, followed by Tangier-Tetouan-Al Hoceima at 58.79%, Rabat-Sale-Kenitra at 56.87%, Casablanca-Settat at 52.83%, Marrakech-Safi at 49.95%, Oriental at 45.99%, Beni Mellal-Khenifra at 43.79%, and Souss-Massa at 24.95%.
The ministry also provided support to its affiliated entities through the preparation of 14 decrees for the removal of the public domain of the state, and the submission of eight draft decrees to the General Secretariat of the Government for publication in the Official Gazette. Additionally, four decisions were prepared to place the water public domain under mortgage, and 17 legal consultations were submitted to central and territorial entities. The ministry issued a single decision to place the public maritime domain under mortgage for the benefit of the National Ports Agency and a decision to authorize temporary occupation of the public maritime domain for the benefit of the company SOMATRIN. In total, 45 files were processed, with 17 handled by legal consultations, 14 by decrees for the removal of the public domain of the state, eight by draft decrees submitted to the General Secretariat of the Government, four by decisions to place the water public domain under mortgage, and one each for the authorization of temporary occupation of the public maritime domain and the placement under mortgage for the benefit of the National Ports Agency.
Regarding decrees announcing or renewing public utility published in the Official Gazette, a total of 16 decrees were issued, distributed between 13 for the roads, highways, and bridges sector and three for the water sector.
In terms of expropriation decisions published in the Official Gazette, a total of 49 decisions were recorded, with 15 for the roads sector.
In addition to these efforts, the ministry has been actively working on the management of public domain assets, including the preparation of legal support for affiliated entities, the issuance of decrees, and the submission of draft decrees for publication. The ministry's work also involves the processing of legal consultations and the issuance of decisions related to the public maritime and water domains.
